1. Agreement to Terms

By accessing Genesis® ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Use License

Permission is granted to temporarily access the materials on Genesis® for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials

• Use the materials for any commercial purpose or public display

• Attempt to decompile or reverse engineer any software contained on Genesis®

• Remove any copyright or proprietary notations from the materials

• Transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Genesis® at any time.

3. Services

Genesis® provides creative design and branding services including but not limited to:

• Web design and development

• Brand identity creation

• Product design

• UX/UI design

• Graphic design

All project deliverables, timelines, and pricing will be outlined in separate project agreements.

4. Project Agreements

Each project will be governed by a separate Statement of Work (SOW) that outlines:

• Scope of work

• Deliverables

• Timeline

• Payment terms

• Revision policy

• Intellectual property rights

5. Payment Terms

• Project deposits are non-refundable

• Payment schedules will be outlined in individual project agreements

• Late payments may result in project delays or suspension

• All prices are in USD unless otherwise specified

6. Intellectual Property

Until final payment is received, Genesis® retains all rights to work created. Upon full payment:

• Client receives agreed-upon usage rights as outlined in the project agreement

• Genesis® retains the right to display work in portfolios and marketing materials

• Client may not resell or redistribute design files without explicit written permission

7. Client Responsibilities

Clients agree to:

• Provide timely feedback and required materials

• Ensure all provided content is legally owned or licensed

• Make payments according to agreed schedules

• Communicate clearly and professionally

8. Revisions and Changes

• Revision rounds will be specified in project agreements

• Additional revisions beyond the agreed scope may incur extra charges

• Major scope changes will require a new project agreement

9. Project Cancellation

• Clients may cancel projects with written notice

• Work completed up to cancellation point will be billed

• Deposits are non-refundable

• Genesis® reserves the right to cancel projects with full refund of unused deposits

10. Limitation of Liability

Genesis® shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.

11. Disclaimer

Materials on Genesis® are provided on an 'as is' basis. Genesis® makes no warranties, expressed or implied, and hereby disclaims all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

12. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website.
